These Terms govern the use of www.lidiavives.com and purchases made from Lídia Vives, a self-employed artist based in Spain. By using the website or placing an order, you agree to these Terms. Mandatory consumer rights always take precedence where applicable.

Artworks, editions and commissions

The store offers original artworks, signed and numbered limited editions and, where stated, other art products. Commissioned photography and bespoke artistic projects are governed by the specific written agreement made with the client.

Each limited edition is supplied according to the edition information stated on its product page. Artist’s Proofs exist only where expressly stated and are included in the disclosed edition structure. Unique artworks are one-of-one and have no Artist’s Proof. Availability and edition numbering are confirmed when the order is accepted.

Standard limited-edition works may be printed after an order is placed. This does not by itself make the work personalized.

Prices, VAT and payment

Prices shown on the website include VAT where applicable. The final order total, including any applicable tax and delivery charge, is shown before payment.

Import duties, customs clearance charges and local taxes outside the European Union are not included unless explicitly stated otherwise. They are payable by the collector.

Payments are processed securely through the payment methods displayed at checkout. An order is not accepted until payment has been authorized and availability, destination eligibility and order details have been verified.

Shipping and delivery

Artworks are shipped using trackable services and are insured in transit. Delivery dates are estimates and may be affected by production time, customs, remote-area service, carrier restrictions or circumstances outside our reasonable control.

We do not accept orders for delivery to Israel or to destinations where the selected carrier cannot lawfully or reliably provide service. If an order cannot be fulfilled, the collector will be contacted and any amount paid will be refunded through the original payment method.

The collector must provide complete and accurate delivery information and cooperate with reasonable customs or carrier requirements.

Returns, damage and cancellations

Returns, statutory withdrawal rights, refunds, damaged deliveries and exclusions for personalized or commissioned works are governed by the Return & Refund Policy published on this website.

If an artwork arrives damaged, incorrect or materially different from its description, contact info@lidiavives.com as soon as reasonably possible, preferably within 48 hours. Keep the artwork and all packaging. Do not destroy or dispose of it unless we give written instructions.

Ownership and intellectual property

Purchasing an artwork transfers ownership of the physical object only. Copyright and all reproduction, commercial, digital and image-use rights remain with Lídia Vives unless agreed otherwise in writing.

Selected press images may be used without prior permission solely for genuine editorial coverage specifically about Lídia Vives or her work, provided that Lídia Vives is visibly credited and www.lidiavives.com is linked where technically possible.

Use of an image as generic illustration, in advertising, merchandise, resale, artificial-intelligence training, datasets or for any purpose unrelated to Lídia Vives or her work requires prior written permission.

Website content and acceptable use

Website texts, images, videos, graphics, logos and design are protected by intellectual-property law. You may not reproduce, scrape, distribute, exploit, remove attribution from or use this content unlawfully.

You must not interfere with the security or operation of the website, introduce malicious code, impersonate another person, provide fraudulent information or use the website in violation of applicable law.

Accuracy and availability

We make reasonable efforts to describe artworks, dimensions, materials, editions and colours accurately. Screens and lighting can affect colour perception. Obvious errors may be corrected before an order is accepted.

Products may be withdrawn or become unavailable. If a paid order cannot be supplied, it will be refunded.

Privacy and third-party services

Personal data is processed as described in the Privacy Policy. Payment, commerce, analytics, email and shipping providers may process information where necessary to provide their services.

Links or services operated by third parties are subject to their own terms and privacy practices.

Liability

Nothing in these Terms excludes or limits liability or consumer rights where doing so would be unlawful. To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable when the contract was formed.

Changes and governing law

These Terms may be updated from time to time. The version displayed when an order is placed applies to that order.

These Terms are governed by Spanish law, without depriving consumers of mandatory protections available in their country of residence. Any dispute will be handled by the competent courts determined by applicable law.
